1. Introduction
Welcome to WISP (Wildfire Simulation Platform). These Terms & Conditions govern your purchase and use of WISP desktop software. By purchasing, installing, or using our software, you agree to be bound by these Terms.
2. Definitions
"Software" refers to the WISP wildfire simulation desktop application and all associated components. "License" refers to the right to use the Software as granted under these Terms. "Licensee" refers to any individual or organization that has purchased a valid license to use the Software. "Documentation" refers to all user guides, technical specifications, and support materials provided with the Software.
3. License Grant
Subject to your compliance with these Terms and payment of applicable fees, WISP grants you a non-exclusive, non-transferable, revocable license to install and use the Software on authorized devices as specified in your license agreement. 4. License Restrictions
You may not: (a) reverse engineer, decompile, or disassemble the Software; (b) rent, lease, lend, sell, redistribute, or sublicense the Software; (c) copy the Software except as expressly permitted; (d) remove or alter any proprietary notices on the Software; (e) use the Software for any illegal purpose; or (f) share your license credentials with unauthorized users.
5. License Activation and Verification
The Software requires activation using a valid license key. The Software may periodically verify your license status. You agree to provide accurate information during activation and to maintain a valid license for continued use.
6. Payment and Fees
All fees are due as specified in your purchase order or invoice. Licenses are sold on a perpetual or subscription basis as indicated at purchase. Subscription licenses require timely payment of renewal fees for continued access. All fees are non-refundable except as required by law or as specified in our refund policy.
7. Software Updates and Support
Active license holders may receive software updates, bug fixes, and technical support as specified in their license agreement. Major version upgrades may require additional fees. Support is provided via our contact form and email support channels.
8. Intellectual Property
The Software, including all algorithms, simulation models, code, documentation, and related materials, is the exclusive property of WISP and is protected by copyright, trademark, patent, and other intellectual property laws. This license does not transfer any ownership rights to you.
9. Data and Simulation Results
You retain ownership of any data you input into the Software and any simulation results generated. However, the Software's proprietary simulation algorithms and methodologies remain the property of WISP. You are responsible for the accuracy of input data and the appropriate use of simulation results.
10. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WISP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WISP does not warrant that the Software will be error-free or uninterrupted. Wildfire simulation results are models and should not be used as the sole basis for critical decisions without professional judgment and verification.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SOFTWARE. Our total liability shall not exceed the amount paid by you for the Software license in the twelve months preceding the claim.
12. License Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use of the Software and destroy all copies. Sections regarding intellectual property, warranties, liability, and governing law survive termination.
13. Export Compliance
You agree to comply with all applicable export and import laws and regulations. You may not use or export the Software in violation of applicable laws or to any prohibited country, entity, or person.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users or posted on our website. Continued use of the Software after such modifications constitutes your acceptance of the updated Terms.
